{"id":4862,"date":"2026-02-24T04:07:27","date_gmt":"2026-02-24T03:07:27","guid":{"rendered":"https:\/\/unsr.albertbarume.org\/site?p=4862"},"modified":"2026-03-09T03:16:35","modified_gmt":"2026-03-09T02:16:35","slug":"ocean-governance-must-be-grounded-in-international-law-un-experts","status":"publish","type":"post","link":"https:\/\/unsr.albertbarume.org\/site?p=4862","title":{"rendered":"Ocean governance must be grounded in international law: UN experts"},"content":{"rendered":"<div class=\"node-news__body\">\n<div class=\"wysiwyg-content field field--name-body field--type-text-with-summary field--label-hidden field__item\">\n<p><strong><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-4823 alignleft\" src=\"https:\/\/unsr.albertbarume.org\/site\/wp-content\/uploads\/2026\/01\/logo-sp-en-1.jpeg\" alt=\"\" width=\"155\" height=\"152\" srcset=\"https:\/\/unsr.albertbarume.org\/site\/wp-content\/uploads\/2026\/01\/logo-sp-en-1.jpeg 350w, https:\/\/unsr.albertbarume.org\/site\/wp-content\/uploads\/2026\/01\/logo-sp-en-1-300x294.jpeg 300w\" sizes=\"auto, (max-width: 155px) 100vw, 155px\" \/>GENEVA<\/strong> \u2013 UN experts* today urged States to ensure that any new regulations governing the deep seabed, including a code on mining, are firmly grounded in international law, including international human rights law, and implement the <a title=\"The precautionary principle and deep-seabed mining: A State obligation under international law that must be urgently respected\" href=\"https:\/\/www.ohchr.org\/en\/documents\/policy-briefs\/precautionary-principle-and-deep-seabed-mining-state-obligation-under\" data-entity-type=\"node\" data-entity-uuid=\"079761cf-1b5f-41d0-b72b-0104e04acf42\" data-entity-substitution=\"canonical\">precautionary principle<\/a>.<\/p>\n<p><em>\u201cThe deep seabed is not an industrial frontier, it is one of the most fragile and least understood ecosystems on Earth, and its protection is a legal obligation under international law and human rights law,\u201d<\/em> the experts said, ahead of the 31<sup>st<\/sup> session of the International Seabed Authority (ISA). \u201cAny regulatory framework must reflect States\u2019 binding obligation to protect the environment and the climate system and prevent human rights and environmental harm.\u201d<\/p>\n<p>The UN experts recalled recent Advisory Opinions of the <a title=\"UN experts welcome recognition from International Court of Justice that all States must protect the climate system \" href=\"https:\/\/www.ohchr.org\/en\/press-releases\/2025\/07\/un-experts-welcome-recognition-international-court-justice-all-states-must\" data-entity-type=\"node\" data-entity-uuid=\"4de1ca45-ff38-41ec-9524-9ef5f486f9ae\" data-entity-substitution=\"canonical\">International Court of Justice<\/a> (ICJ) and <a title=\"Law of the sea tribunal\u2019s judgment on marine environment and climate change underscores obligations, say UN experts\" href=\"https:\/\/www.ohchr.org\/en\/press-releases\/2024\/05\/law-sea-tribunals-judgment-marine-environment-and-climate-change-underscores\" data-entity-type=\"node\" data-entity-uuid=\"c067728d-fa11-4dae-bcf6-503a5672cea7\" data-entity-substitution=\"canonical\">the International Tribunal on the Law of the Sea<\/a> (ITLOS) which clarify obligations to protect the <a href=\"https:\/\/docs.un.org\/en\/A\/HRC\/58\/59\">ocean<\/a> and the climate system. Under customary international law, States have obligations to protect the marine environment and the climate system that are owed to the international community as a whole \u2013 obligations that require stringent due diligence. The Biodiversity Beyond National Jurisdiction (<a href=\"https:\/\/www.un.org\/bbnjagreement\/en\/bbnj-agreement\/text-bbnj-agreement\">BBNJ<\/a>) Agreement, which recently came into force, strengthens this legal framework. All these international obligations must be considered and respected by the International Seabed Authority.<\/p>\n<p>The experts also reminded that businesses have obligations and responsibilities with respect to the protection of the environment and the climate system, and their impacts on human rights, in line with the UN Guiding Principles on Business and Human Rights.<\/p>\n<p>\u201cThe deep seabed hosts most of the ocean\u2019s estimated one million species, sustains global biodiversity, and constitutes the planet\u2019s largest carbon sink, thus being critical for climate regulation,\u201d the experts said.<\/p>\n<p>They warned that deep-sea mining linked with the rush to <a title=\"A\/80\/188: A human rights-based approach to the energy transition\" href=\"https:\/\/www.ohchr.org\/en\/documents\/thematic-reports\/a80188-human-rights-based-approach-energy-transition\" data-entity-type=\"node\" data-entity-uuid=\"538b783d-22c1-481e-98bb-37372e41e782\" data-entity-substitution=\"canonical\">critical minerals<\/a> poses serious environmental, climate and human rights risks. Scientific research increasingly suggests that such mining could cause severe and potentially irreversible damage to marine biodiversity, disperse toxic pollutants, destroy seafloor habitats, release stored carbon, and disrupt ocean carbon sequestration processes. In addition, mining operations are highly energy-intensive and contribute to greenhouse gas emissions which aggravate the climate crisis and its adverse human rights impacts.<\/p>\n<p>\u201cCourts have concluded that the precautionary principle must be respected when there is scientific uncertainty about how to effectively prevent significant or irreversible harm to the environment and to human health of present and future generations, as in the case of deep-sea bed mining\u201d the experts said.<\/p>\n<p>Indigenous Peoples, small-scale fishers, and Small Island Developing States rely heavily on healthy marine ecosystems for food security, livelihoods and culture, which increases their vulnerability to potential impacts.<\/p>\n<p>\u201cThreats to the deep sea are threats to human rights,\u201d the experts said. \u201cIndigenous Peoples, small-scale fishers and coastal communities all depend on a healthy ocean to survive.
