Información recibida en relación con el uso instrumental del derecho penal contra personas defensoras de los derechos humanos en asuntos ambientales y actores de la sociedad civil vinculados al colectivo ciudadano YASunidos en Ecuador, a raíz de su participación en la promoción e implementación de la consulta popular sobre el Yasuní de 2023.

Seguimiento a nuestro diálogo con el Gobierno de Su Excelencia y empresas asociadas, incluida la empresa pública Grupo Mundo Maya, en relación con el megaproyecto “Tren Maya”, que se encuentra principalmente bajo el control de la Secretaría de la Defensa Nacional (SEDENA) y sus extensiones, y reiterar nuestra preocupación expresada de que el proyecto podría poner en peligro los derechos de los Pueblos Indígenas y otras comunidades a la tierra y los recursos naturales, así como los derechos culturales y el derecho a un medio ambiente saludable y sostenible.

Información recibida en relación con los decretos que regulan el Registro Público de Personas y Entidades vinculadas a actos de Terrorismo y su Financiamiento (RePET), establecido por el Decreto n°489/2019. Nos preocupa que estas disposiciones puedan no ser compatibles con el derecho internacional de los derechos humanos.

Información relativa al decreto núm. 11‑2025: Ley para el combate frontal de los grupos delictivos u organizaciones criminales transnacionales y terroristas denominados maras o pandillas (“el Decreto”), en vigor desde el 11 de noviembre de 2025. Nos preocupa que ciertos elementos del Decreto resulten incompatibles con el derecho internacional de los derechos humanos, incluidos el principio de legalidad, las garantías del debido proceso en la designación de organizaciones como terroristas o criminales, así como los estándares internacionales sobre las condiciones de detención. Asimismo, nos preocupa que el Decreto equipare los marcos jurídicos y las amenazas propias del crimen organizado y del terrorismo, lo cual podría conllevar restricciones innecesarias y desproporcionadas a los derechos humanos.

Information received concerning the arbitrary arrest, detention and criminal prosecution – following a series of coordinated detentions, interrogations and searches of Indigenous activists across several regions of the Russian Federation on 17 December 2025 – of Ms. Daria Egereva, an Indigenous human rights defender of the Selkup people, and Co-Chair of the International Indigenous Peoples Forum on Climate Change (IIPFCC) which is the official Indigenous Peoples’ constituency to the United Nations Framework Convention on Climate Change (UNFCCC), and Ms. Natalia Leongardt, the colleague of Ms. Egereva. The information received strongly indicates that the prosecution of Ms. Daria Egereva might constitute acts of intimidation and reprisals for engaging with the United Nations, its representatives, and mechanisms in the field of human rights.

Information received concerning imminent actions that may cause irreversible harm to the ability of the Indigenous Western Apache Peoples to freely practice their religion at Chi’chil Biłdagoteel (Oak Flat), a sacred site of profound religious, cultural and ceremonial significance. Oak Flat is indispensable to Apache religious life, including the Sunrise Ceremony (Na’ii’ees), a coming of age ceremony central to the religious and cultural identity of Apache girls. The United States’ recent transfer of the land to mining interests has created an immediate and ongoing risk of irreversible interference with the religious freedoms of the Western Apache Peoples.

Information received concerning allegations of ethnic, sex and gender specific discrimination related to the use of parenting competency tests including psychometric tests – known as FKU-, which has led to the forced removal and continued separation of three children from their mother, Ms. Keira Kronvold, for being an Inuk indigenous woman of Greenland and lives in Thisted, Denmark.

Información recibida en relación con alegaciones de violencia obstétrica sistemática en Perú, una forma de violencia de género que afectaría de manera desproporcionada a personas gestantes pertenecientes a Pueblos Indígenas, campesinas y quechuahablantes, vulnerando los derechos a la salud, autonomía reproductiva, diversidad cultural, igualdad y no discriminación. Informations reçues concernant des allégations de meurtres et d'autres actes de violence à l'encontre de membres des Peuples Autochtones Mbororo, y compris des femmes et des enfants, dans la région du Nord-Ouest du Cameroun, qui auraient été commis dans le contexte du conflit armé en cours opposant les forces de l'État et des groupes armés non étatiques.

Información recibida en relación con la detención del Sr. Versaín Velasco García, defensor de derechos humanos maya tzotzil, y el desplazamiento forzado de su familia.

Preocupaciones relativas a: (i) los artículos 366 y 367 del Código Orgánico Integral Penal (COIP); (ii) la Ley Orgánica de Inteligencia (en adelante, “Ley de Inteligencia”), adoptada por la Asamblea Nacional el 10 de junio de 2025 y publicada en el Registro Oficial el 11 de junio de 2025; (iii) los Decretos Ejecutivos Nos. 730 y 111, de 3 de mayo de 2023 y 9 de enero de 2024, respectivamente; y (iv) los decretos ejecutivos mediante los cuales se han prorrogado sucesivamente los estados de excepción. Nos preocupa que ciertos elementos de estas medidas no sean plenamente compatibles con las obligaciones internacionales de Ecuador en materia de derechos humanos, incluido el Pacto Internacional de Derechos Civiles y Políticos (PIDCP), ratificado por Ecuador el 6 de marzo de 1969, en particular en lo que respecta al principio de legalidad, el derecho a un recurso efectivo, el derecho a la privacidad y la protección de los datos personales, la supervisión independiente y la rendición de cuentas de las actividades de inteligencia y de las fuerzas armadas, así como los posibles impactos sobre los derechos a la vida, la libertad, la libertad de expresión, de reunión pacífica y de asociación, el debido proceso, las garantías de un juicio justo y las prohibiciones de la tortura y otros tratos o penas crueles, inhumanos o degradantes.

Información recibida sobre alegaciones de detención arbitraria, así como agresiones físicas y sexuales perpetradas contra la defensora indígena Otomí, Estela Hernández Jiménez. Dichos hechos se habrían producido en el marco de la reivindicación de los derechos de la comunidad del Pueblo Indígena Otomí de Santiago Mexquititlán, por la defensa de sus fuentes tradicionales de agua, situación que ha derivado en actos de hostigamiento y criminalización dirigidos contra personas defensoras de dicha comunidad.

Information concerning the recurrent involvement of military officials from Bangladesh in alleged human rights violations against Indigenous Peoples in the country.

Information received concerning the human rights situation in Nicaragua, particularly regarding the state of food insecurity in the country and State policies that, in our view, may fail to guarantee access to adequate food in accordance with applicable international human rights standards. This situation has a particularly negative impact on vulnerable groups, as well as on the Miskitu and Mayangna Indigenous Peoples in the North Caribbean Coast Autonomous Region (RACCN) of Nicaragua. The current situation hinders the exercise and guarantee of the rights to adequate food, to a decent standard of living and to health, while also facilitating land grabbing by mining and extractive companies, and restricting or denying access to agricultural land and to the ancestral territories of Indigenous Peoples.

Information received concerning allegations of serious and systematic human rights violations against Indigenous Peoples in Panama, in the context of social protests that began in April 2025. The allegations include excessive use of force, undue suspension of constitutional guarantees, arbitrary detention, torture, sexual violence, criminalization and repression of indigenous leaders, criminalization of protest, hate speech, stigmatization and territorial dispossession. Highlighted among the underlying problems are the lack of guarantees for indigenous territorial rights, including free, prior and informed consultation and consent, as well as the dismantling of institutional dialogue mechanisms.

Information received concerning the lack of measures for truth, justice, reparation, memorialization and guarantees of non-repetition for the serious human rights violations committed against Indigenous Peoples of the Putumayo region during the so-called Rubber Era.

Information received concerning alleged acts of intimidation, threats and arson against indigenous defenders and leaders of the Seque Jahuira community of the Aymara Nation, and members of the non-governmental organization Qhana Pukara Kurmi.

Information received concerning the deterioration of fundamental freedoms and civic space in Ecuador, including allegations of violations of freedom of expression, freedom of peaceful assembly and association; persecution of civil society organizations, Indigenous Peoples, social movements and their leaders, including the opening of criminal investigations and freezing of accounts; undue use of force, less-lethal weapons, temporary disappearances and arbitrary detentions in the context of peaceful assemblies that have caused at least one death; as well as violence and cruel, inhuman and degrading treatment during arbitrary detentions, and actions obstructing judicial independence.

Information received concerning a series of grave human rights violations against Indigenous Peoples in the Chittagong Hill Tracts (CHT) of Bangladesh, including sexual and gender-based violence, the repression of peaceful protests, which resulted in the killing of at least five individuals, the injuring of at least four and the enforced disappearance of five; as well as regarding the alleged racially motivated attacks against Indigenous Peoples, reportedly coordinated between settlers and the military, which took the form of looting and burning homes and businesses, displacing dozens of families.

Information received concerning allegations of the ongoing widespread and discriminatory removals of Aboriginal children from their families by child protection authorities in Western Australia. While the practices have deep historical roots, dating back to systemic removal policies of previous decades, the concern remains highly relevant today. Despite the national apology nearly two decades ago—a significant moment in acknowledging the profound trauma caused by such practices—Australia’s First Nations children continue to be removed from their families of origin at alarming rates. The ongoing overrepresentation of Aboriginal children in out-of-home care suggests that the process of healing and reform remains incomplete. Such decisions to separate children from their families allegedly take place routinely in response to conditions of structural poverty and housing insecurity, and without adequate procedural safeguards. These practices appear incompatible with Australia's obligations under international human rights law, in particular the Convention on the Rights of the Child (CRC), the International Covenant on Economic, Social and Cultural Rights (ICESCR), and the United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP).

Information received concerning the enactment of new legal norms, specifically: I) the Organic Law for the Strengthening of Protected Areas, of 11 July 2025; and II) Executive Decree No. 60, of 24 July 2025, providing for institutional reorganization measures within the Executive Branch. These norms, enacted under the "Administrative Efficiency Plan" through which the government seeks institutional reform based on "optimization, austerity and efficiency criteria", could be regressive with respect to human rights protection, including the human right to a clean, healthy and sustainable environment as recognized in the Constitution of Ecuador, the Inter-American System and the United Nations system. The norms could also be contrary to the State's international obligation to prevent environmental harm, including to the climate system.

Information received concerning the alleged serious violation of the human right to drinking water, the right to adequate housing, the right to a clean, healthy and sustainable environment, and the rights of Indigenous Peoples, affecting the inhabitants of the village of Santa Cruz de Chinautla, municipality of Chinautla, in the department of Guatemala, inhabited primarily by the Maya Poqomam Indigenous People.

Concerns the human rights situation of Indigenous Peoples in Indonesia. These include the lack of formal recognition of Indigenous Peoples; the erosion of their rights under the revised Special Autonomy Law in West Papua; the revival of the transmigration policy and its detrimental impact on cultural integrity; and the adverse effects of National Strategic Projects, extractive industries, and green energy initiatives on Indigenous lands and livelihoods. We also highlight specific cases, such as the expansion of nickel mining in Kabaena and its impact on the Bajau Indigenous Peoples and the dispossession and threats faced by the Cek Bocek Indigenous Peoples in Sumbawa. We have also received allegations of the exclusion of Indigenous communities from conservation efforts, affecting their territories, lands and resources. Additional concerns include the criminalization of Indigenous land defenders and the existential threats faced by Indigenous Peoples in isolation.

Information received concerning alleged violations of the rights of Indigenous Peoples in the Chittagong Hill Tracts (CHT), Bangladesh. The allegations concern land grabbing and violations of the Mro Peoples’s rights to food, water, health, a clean, healthy and sustainable environment, and cultural rights and affecting disproportionally women and children. The violations are linked to the construction of a hotel by Sikder Group conglomerate company R&R Holdings Limited, together with the 24th Division and 69th Brigade of the Bangladesh Army and the Army Welfare Trust. The project is taking place on Mro ancestral land in Chimbuk, Bandarban district.

Information received concerning alleged violations of the rights of Indigenous Peoples in the Chittagong Hill Tracts (CHT) in Bangladesh, including reported infringements of their rights to food, housing, water, health, a clean, healthy - sustainable environment, and cultural rights, with women and children particularly vulnerable to the consequences. These communities are exposed to continuous marginalization and systematic discriminatory practices that adversely affect their livelihoods. Additionally, Indigenous Peoples, their leaders, advocates and human rights defenders reportedly face criminalization and intimidation due to the high presence of military personnel in the region.

Informations reçues concernant les conséquences négatives sur les droits humains que causent la construction et la mise en opération d’une usine d’ammoniac dans la municipalité de Ahome, Sinaloa, Mexico, par l’entreprise Gas y Petroquímica de Occidente (GPO), filiale de la société Suisse PROMAN. Ces activités affectent les droits des Peuples Autochtones, des communautés de pêcheurs, les enfants, et tous les résidents de la région, en particulier leur droit à un environnement propre, sain et durable, leur droit à la santé, leur droit au développement et leur droit de maintenir certains modes de vie et pratiques culturelles liés à la nature et à la terre, et dont la mise en œuvre semble avoir porté atteinte à leur droit à défendre leurs droits humains, notamment leurs libertés d'expression, de réunion et d'association. Les émissions résultant de l'exploitation de l'usine contribuent également au changement climatique, avec des impacts négatifs supplémentaires sur les droits humains. De plus, la production et l'utilisation de produits pétrochimiques ont des répercussions sur les droits humains en aggravant le changement climatique, la perte de biodiversité et la pollution toxique. Ce projet d’usine d’ammoniac aurait été approuvé sans consultation appropriée des habitants de la région ni avec le consentement libre, préalable et éclairé des Peuples Autochtones concernés.

These activities would affect Indigenous Peoples, fishing communities, children, and all residents of the area, in particular their right to a clean, healthy, and sustainable environment, their right to health, their right to development, and to maintain specific ways of life and cultural practices related to nature and the land, and the implementation of which seems to have raised obstacle to their right to defend human rights, including freedom of expression, assembly and association, among others. Emissions resulting from the plant's operations, as well as the production and use of petrochemicals, will also contribute to climate change, exacerbate biodiversity loss, and toxic pollution, with additional negative impacts on human rights. This project of ammoniac plant is reportedly being financed by KFW IPEX-Bank, domiciled in Germany and by additional financial resources from the German Government, and has been approved without adequate consultation with the inhabitants of the region, and the free, prior and informed consent of the Indigenous Peoples concerned.

These activities would affect Indigenous Peoples, fishing communities, children and all persons in the area, in particular their right to a clean, healthy and sustainable environment, their right to health, their right to development and their right to maintain nature- and land-related cultural practices and ways of life. Implementation of the project may also have imposed obstacles on the right to defend human rights, including freedoms of expression, assembly and association. Emissions from plant operations and the production and use of petrochemical products also contribute to climate change and exacerbate biodiversity loss and toxic pollution, with additional negative human rights implications. Information received concerning alleged threats against Ch'ol indigenous defender Mr. Santiago Jiménez Jiménez by armed groups in the municipality of Tila in the State of Chiapas.

Information received concerning proposed infrastructure projects aimed at the transportation, storage and processing of liquified natural gas (LNG) in the Gulf of California in Mexico, by numerous businesses entreprises including Mexico Pacific Limited, Epcilon LNG LLC U.S.A. and Sempra Infrastructure (headquartered in the United States of America), GNL Cosalá S. A. DE C. V (headquartered in Mexico), and LNG Alliance Pte Ltd Singapore (headquartered in Singapore), with potential negative impacts on a wide range of human rights in the context of climate change. These projects would also put the ecosystems of the Gulf at risk and appear to go against the goals, obligations and commitments under the Paris Agreement, contributing to the expansion of LNG exploitation.

The alleged worrying actions by the Government include: the proposed Regulatory Standards Bill, which excludes Māori legal traditions and undermines Treaty of Waitangi obligations; the enactment of the Ngāti Kahungunu ki Wairarapa Tāmaki nui-ā-Rua Settlement Act, which overrode a Supreme Court ruling and extinguished a land claim without free, prior, and informed consent; and the Nelson Tenths case, where the Government appealed a High Court ruling in favor of Māori land return and compensation.

We have also received allegations of serious violations of the rights to due process, physical integrity, freedom of expression, freedom of peaceful assembly and freedom of association in the context of social protests against the adoption of the constitutional reform in the Province of Jujuy. We are further concerned that the reform would affect the right to freedom of expression and assembly and the right to collective property of Indigenous Peoples over their lands, territories and resources. Additionally, we express concern regarding information received about the detention of lawyer and human rights defender Alberto Elias Nallar, who provided legal assistance and support to persons detained in connection with the protests in the Province of Jujuy.

According to these allegations several extra-judicial killings, including of three children took place in the town of Wamena, Jayawijaya Regency, Papua Pegunungan Province (Mountains Papua Province) on 23 February 2023; the allegations refer to the practice of arbitrary detention and excessive use of force, including lethal force, by security forces resulting in serious injuries to Indigenous Papuans protesters and human rights activists in the context of civil unrest and armed rebellion between May 2022 and July 2023.

Information received concerning the alleged use of excessive and lethal force by law enforcement against a group of Indigenous individuals and over the alleged ill-treatment of detainees by law enforcement officials. Information received concerning the alleged lack of an effective and prompt investigation into the killing of Mr. Uakhele Giban, an indigenous Papuan, on 5 July 2022 in Suru Suru district, Yahukimo regency, allegedly by agents of the Indonesian security forces of the Damai Cartenz Unit, the alleged killings of Arlod Lokbere, Irian Nigiri, Lemaniol Nigiri, and Atis Tini, indegenous Papuans, in Mimika Regency, Nduga, in the Indonesian province of Papua on 22 August 2022, reportedly by members of the Indonesian Army from Brigif 20 and the alleged excessive use of force against an indigenous Papuan minor, on 15 April 2022. These cases appear to occur in the context of ongoing practices of excessive use of force, extrajudicial killings, and torture of indigenous Papuans by Indonesian police, military or joint security forces.

Information received concerning the situation of risk faced by the Amazonian Kichwa nationality of the Tzawata-Illa-Chukapi community before a possible imminent eviction of 150 families (approximately 400 persons, including 150 children), with pending judicial requests in the case. We are concerned about the lack of recognition and titling of the ancestral territory of this nationality, as well as the violation of their right to free, prior and informed consultation and consent with regard to economic projects (mining and monoculture farming) on their ancestral territory.
